WARRANTS

There are two primary types of warrants: criminal arrest warrants and search warrants. In Rolling Fork, warrants are issued by a judge or other authorized judicial officer in accordance with state and constitutional law.

Criminal arrest warrants may be issued when there is sufficient legal cause to believe an individual committed a criminal offense (misdemeanor or felony). If an arrest is made, the person will be processed through the criminal justice system, and bond (if applicable) will be addressed by the court.

Search warrants authorize law enforcement to search a specific place and to seize specific items described in the warrant. Search warrants are issued only upon a proper legal showing (typically, probable cause supported by oath or affirmation) and must comply with constitutional requirements.

If you believe a crime or violation has occurred and you want to pursue a warrant, you should first report the incident to the Rolling Fork Police Department so a report can be taken and a case number assigned. Generally, the incident must fall within the City’s jurisdiction for the City to initiate the process. After a report is made, you may be required to provide additional information and, in some circumstances, sign a sworn statement or affidavit for review by the appropriate judicial officer. The judge or authorized official will determine whether legal grounds exist to issue a warrant.

If a case moves forward to court, witnesses may be served with a subpoena to appear and testify. Failure to comply with a subpoena may result in court action, which can include sanctions and, in some cases, the issuance of a warrant.

Arrest warrants and search warrants are served by law enforcement officers.
